These Terms of Service (the "Terms") govern your access to and use of the website, mobile application, products and services of Oasis Water Technologies, Inc. ("Oasis Water Technologies," "we," "us" or "our"). By browsing our site, creating an account or placing an order, you agree to these Terms. If you do not agree, please do not use our services.

1. Eligibility and accounts

You must be at least 18 years old to purchase from us. If you create an account, you are responsible for the accuracy of the information you provide and for all activity that occurs under your account. Please tell us promptly at support@oasiswatertechnologies.com if you believe your account has been accessed without your permission.

2. Orders, pricing and availability

All orders are offers to purchase and are subject to acceptance by us. Prices, product descriptions and availability may change without notice. If a product is listed at an incorrect price or with incorrect information because of an error, we may cancel or decline the order and refund any amount charged. Applicable sales tax is calculated at checkout.

3. Shipping and risk of loss

Shipping terms, delivery estimates and destination limits are set out in our Shipping Policy, which forms part of these Terms. Title and risk of loss pass to you when the carrier delivers the order to the address you provided.

4. Returns and refunds

Returns and refunds are governed by our Refund Policy, which forms part of these Terms. All returns must be authorized by us before you ship anything back.

5. Product installation

Whole-home filtration systems connect to your home plumbing and should be installed in accordance with the product documentation and all applicable local plumbing codes. We recommend installation by a licensed plumber. You are responsible for installation and removal costs, including any plumber or contractor fees. We are not responsible for damage arising from installation that does not follow the product documentation or applicable code.

6. Limited warranty

The Nexxus system is covered by a 12-month limited warranty against defects in materials and workmanship from the date of delivery. The warranty does not cover normal wear, consumable filter media, damage from misuse, accident, freezing, water pressure or chemistry outside the product specifications, unauthorized modification, or installation that does not follow the product documentation. Contact support@oasiswatertechnologies.com to make a warranty claim and for the full warranty terms applicable to your product.

7. Delta Plan subscriptions

The Delta Plan is a subscription program with its own billing, minimum term, cancellation and benefit terms, which are set out in the Nexxus Delta Plan Subscription Agreement that you agree to at enrollment. Where those terms and these Terms conflict, the Subscription Agreement controls for the subscription.

8. The mobile application and connected devices

Our mobile application lets you monitor your system, manage filter replacement and contact support. Use of the application requires an account and an internet connection, and features that depend on a connected device require that device to be online. Device readings, filter-life estimates and alerts are provided for convenience and are not a substitute for professional water testing or for your own judgment about your water. We may update, change or discontinue application features.

9. Acceptable use

You agree not to misuse our services: no unlawful use, no interference with or disruption of our systems, no attempt to gain unauthorized access to any account or system, no scraping or automated data collection without our written permission, and no resale of our products or services without our written permission.

10. Intellectual property

The Oasis Water Technologies and Nexxus names and logos, and the content, design, text, graphics and software on our website and in our application, are owned by us or our licensors and are protected by intellectual property laws. You may not copy, modify, distribute or create derivative works from them without our written permission.

11. User content and feedback

If you send us reviews, photographs, suggestions or other content, you grant us a non-exclusive, royalty-free, worldwide licence to use it in connection with our business. You confirm that you have the right to share anything you send us.

12. Third-party links and services

Our website and application may link to or rely on third-party services. We are not responsible for the content, policies or practices of third parties.

13. Disclaimers

Except for the limited warranty above and any rights you have that cannot be excluded under applicable law, our products and services are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that our website or application will be uninterrupted or error-free.

14. Limitation of liability

To the fullest extent permitted by law, Oasis Water Technologies is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data or business interruption, arising out of or relating to your use of our products or services. To the fullest extent permitted by law, our total liability for any claim relating to a product or order is limited to the amount you paid for that product or order. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

15. Indemnity

You agree to indemnify and hold harmless Oasis Water Technologies and its officers, directors, employees and agents from claims, damages and expenses, including reasonable legal fees, arising out of your misuse of our products or services or your breach of these Terms.

16. Governing law and disputes

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or our products and services will be brought exclusively in the state or federal courts located in Los Angeles County, California, and you consent to the jurisdiction of those courts. Nothing in this section prevents either party from seeking relief in small-claims court.

17. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date will reflect the current version, and your continued use of our services after an update constitutes acceptance of the revised Terms.
